AND UPON hearing Counsel for the Petitioners and the Respondent’s representative at a hearing on 11 May 2015
IT IS ORDERED THAT:
Hisham Farouk is hereby appointed as the Provisional Liquidator of Fedora Solution International Holdings Ltd (Dubai), registered in the DIFC under registration number CL0846 with its registered offices at Office 511, Level 5, Liberty House, Dubai International Financial Centre, PO Box 506812, Dubai.
The Provisional Liquidator shall have all the powers as set out in Schedule 3 of the DIFC Insolvency Law No. 3 of 2009.
The return date of the Petition shall be Monday 8 June 2015, prior to which the advertisement pursuant to RDC 54.61 will be published in accordance with the relevant Practice Direction (PD 3/2011).
Pursuant to RDC103, which sets out the requirements for the advertisement of appointment, the advertisement shall specifically state that any person intending to appear at the hearing shall give to the Petitioners and the Provisional Liquidator notice of their intention, specifying whether or not they intend to support or oppose the petition, and whether or not they object to the appointment of Mr. Hisham Farouk as Provisional Liquidator, by no later than Monday, 1 June 2015, and if no such notice is provided, then they shall not be able to appear at the hearing of the petition without further order of the Court.
The Liquidator shall be at liberty to apply for further or other directions as deemed necessary.
The costs of the aforementioned advertisement shall be paid by the Petitioners.
The costs of this application will be dealt with in the liquidation.
