UPON the Application No.6 filed by the Defendant on 15 March 2015 to give oral evidence at the trial via video link from the Australia,
AND UPON reviewing the witness statement of Tarek Shrayh dated 24 March 2015,
AND PURSUANT to Schedule B to Part 23 of the Rules of the DIFC Courts (“RDC”);
IT IS HEREBY ORDERED THAT:
1. The Defendant is allowed to give oral evidence at the trial, listed on ( ) (as required), via video link from the Australia.
2. The modalities of how the video conferencing evidence is to be given are to be agreed in a protocol and failing agreement be settled by the Registrar and to be consistent with Schedule B to Part 23 of the Courts Rules.
3. The costs of arranging the video link, use of the video conference facility and any associated costs are to be borne in the first instance by the Defendant; ultimate liability for those costs shall be costs in the case.
