RULING ON APPLICATION UNDER DIFC RULE 36.40 TO CORRECT TYPOGRAPHICAL ERROR IN JUDGMENT

1. The Judgment was issued on 5 May 2011.

 

2. By letter dated 13 December 2011 the Applicant applied, without notice, for correction of a typing error in the Judgment.

 

3. It is with no doubt that the Representative's name was an accidental slip and a typographical error since the evidence was clear that the Representative who appeared was Artemis Artemi of DLA Piper Middle East LLP.

 

4. In view of the explicit findings to which have been referred, there is no doubt that:

(i) The accidental slip is obvious; and
(ii) A hearing of the Application would not be appropriate

 

5. Accordingly, the accidental slip (typographical error) in the parties section is hereby corrected and the parties section shall be taken to refer to Artemis Artemi of DLA Piper Middle East LLP as the Representative for the Second Respondent.
