CONSENT ORDER
UPON the Judgment of Chief Justice Zaki Azmi, H.E. Deputy Chief Justice Ali Al Madhani and Justice Lord Angus Glennie dated 6 September 2023
AND UPON the Consent Order dated 12 October 2023 which provides that the Parties shall exchange submissions on costs within skeleton arguments by no later than 5pm GST on 20 October 2023 (the “Consent Order dated 12 October 2023”) (the "Costs Submissions")
AND UPON a costs hearing listed for 3pm GST on 26 October 2023 (the “Costs Hearing”)
AND UPON the Defendants/ Appellants’ Application No. CA-003-2023/3 dated 28 September 2023 for an order that payments made into Court be returned which was deemed served on the Claimants/ Respondents on 2 October 2023 (the "Payment Return Application")
AND UPON the Parties’ agreement as to matters pertaining to the Costs Hearing and the Payment Return Application
AND UPON the Parties’ agreement to the terms of this Consent Order
IT IS HEREBY ORDERED BY CONSENT THAT:
1. The Parties shall exchange their evidence/submissions on the Payment Return Application, together with the Costs Submissions, by no later than 5pm GST on 20 October 2023.
2. The Payment Return Application shall be heard and decided at the Costs Hearing.
3. There shall be no order as to costs.
