CONSENT ORDER
UPON Justice Roger Giles having given judgment in this matter in the first instance proceedings, case number CFI-045-2012, on 22 May 2014, including awarding the Claimant its costs less certain deductions;
AND UPON the Court of Appeal upholding and varying that judgment by way of Order of 25 December 2014 and awarding the Claimant the majority of its costs of the appeal and its costs as awarded in the first instance proceedings subject to certain amendments;
AND UPON the Claimant having commenced assessment proceedings in relation to both its costs of the first instance proceedings and the appeal;
AND UPON the parties having agreed to the terms set forth below by way of Consent Order dated 4 March 2015;
IT IS HEREBY ORDERED BY CONSENT THAT:
1. The Defendant shall pay the Claimant the sum of US$ 650,000 by no later than 18 March 2015, in full and final settlement of all costs asserted by the Claimant in the first instance proceedings and the appeal and the record shall reflect the satisfaction of all costs upon such payment being made.
2. The detailed assessment proceedings commenced in CFI-045-2012 and CA-006-2014 shall be dismissed.
