AND UPON the Respondent having filed its Reply to the Appellant's Points of Dispute on 16 August 2018, and its Statement of Costs in relation to the present costs assessment on 27 September 2018
AND UPON reviewing the parties' submissions
AND UPON hearing Counsel for the Respondent and the Appellant at the detailed costs assessment hearing held before Deputy Registrar Nour Hineidi Kirk on 27 November 2018
AND UPON reviewing the rules of the DIFC Courts ("RDC")
IT IS HEREBY THAT:
1.The following sums are payable by the Appellant to the Respondent:
a. USD 38,722.50 in respect of the Respondent's costs of the CA-10-2016 proceedings; and
b. USD 13,073.66 in respect of the Respondent's costs of the costs assessment proceedings.
2. The Appellant shall pay the Respondent the sums ordered in paragraph 1 of this Costs Certificate within 21 days from the date of the Costs Certificate.
