UPON reviewing the Appellant’s Appeal Notice and supporting documents seeking to appeal the Order with Reasons of Justice Roger Giles dated 10 November 2016
AND UPON hearing the Appellant and Counsel for the Respondent on 13 and 14 September 2017
AND UPON reviewing the relevant documents recorded on the case file
IT IS HEREBY ORDERED THAT:
1.The case be referred to the Court of First Instance for an expedited trial to be listed.
2. The Appellant shall file and serve an Amended Defence by no later than 4pm on Thursday 28 September 2017.
3. After the filing of the Amended Defence, a Case Management Conference shall be listed at the earliest possible date by the Registry with a view to issuing directions for an early trial.
4. Any application for an adjournment of the trial on medical grounds shall be made at least one month prior to the hearing date, supported by medical evidence, with the certifying doctor available to be examined on the medical evidence by way of videoconferencing.
5. Costs of the Appeal are reserved.
