UPON the appeal of the Appellant, CAROL, from the Order made by the Small Claims Tribunal on 6 February 2012;

AND UPON reading the said Order, the Appeal Notice and the other documents on the Court file;

AND UPON hearing the Appellant in person and counsel instructed by the Respondents;

AND UPON amendment being made to the Order of 9 September 2012, in particular the second direction contained therein

IT IS HEREBY ORDERED THAT:

1. the Appeal be allowed and the Order of 6 February 2012 be set aside.
2. the proceedings against CHRIS be struck out for want of jurisdiction.
3. CIRO pay to the Appellant within 14 days of 9 September 2012 the sum of AED 321,563.
4. CIRO pay to the Appellant within 14 days of 9 September 2012 in respect of his costs the sum of AED 9,263 (being the Court fees incurred by the Appellant in bringing these proceedings).
