CONSENT ORDER
UPON the Agreed Case Management Order dated 11 October 2021
AND UPON the Claimant and Defendant (the “Parties”) engaging in alternative dispute resolution (“ADR”)
AND UPON the action under Claim No. CFI-001-2021 (the “Proceedings”) being stayed to allow the parties to engage in ADR
AND UPON the Parties having agreed confidential terms of settlement in relation to these Proceedings pursuant to a Settlement Agreement dated 1 November 2021
AND UPON the Claimant filing and serving a Notice of Discontinuance pursuant to Part 34 of the Rules of the DIFC Courts
IT IS HEREBY ORDERED BY CONSENT THAT:
1. The Parties have reached an amicable resolution of all claims relating to the Proceedings. The Parties have entered into a binding settlement agreement reflecting the confidential terms of the settlement.
2. The Parties have agreed to withdraw all claims and requests for relief against one another pursuant to RDC 34.3 and otherwise.
3. The Parties have agreed that the obligations pursuant to Order of Justice Lord Angus Glennie dated 12 July 2021 (the “July 2021 Order”) have been satisfied and that all obligations under the July 2021 Order have been discharged herewith.
4. The action under Claim No. CFI-001-2021 shall be discontinued.
5. There shall be no order as to costs except that under RDC 34.15 there shall be no liability for the defendant’s costs.
6. This Order supersedes all other orders in these Proceedings and waives all obligations in accordance with any previous orders issued in these Proceedings. The associated undertakings contained within those orders are discharged.
