ORDER
PENAL NOTICE
IF YOU HUSAM A. ABU-AMARA, GLOBALSTAR TELECOM & TECHNOLOGY, AMEERDEEN ABDUL MAJID THANIKKODI, SYED MOHAMED A/L KABDUL RAHMAN, AI GLOBAL RESOURCES, EVERYONE'S INTERNET, TIME TELECOMMUNICATIONS or SELECT SOLUTIONS LLC. DISOBEY THIS ORDER YOU MAY BE HELD TO BE IN CONTEMPT OF COURT.
ANY OTHER PERSON WHO KNOWS OF THIS ORDER AND DOES ANYTHING WHICH HELPS OR PERMITS THE RESPONDENTS TO BREACH THE TERMS OF THIS ORDER MAY ALSO BE HELD TO BE IN CONTEMPT OF COURT.
UPON the application of the Dubai Financial Services Authority ("DFSA") with notice to the Defendants,
AND UPON and upon hearing counsel for the Claimant and the 1st and 2nd Defendants in person,
AND the 3rd, 4th, 5th, 6th, 7th and 8th Defendants not appearing,
AND UPON undertakings given on behalf of the DFSA forthwith:
(i) To file further affidavits or alternatively to produce drafts affidavits for consideration by the
Court relating to their most recent information provided to the Court during the hearing on 27th February 2007 relating to this application; and
(ii) To file an affidavit explaining why the undertaking given to the Court by the Claimant at the hearing on 14th February 2007 requiring service on all Defendants of materials placed before the Court was not complied with;
IT IS ORDERED as follows:
1. This hearing shall be private and the terms of this Order shall not be publicized without leave from the Court, save that the DFSA may confirm publicly that the order made on 14th February 2007 has been continued against the 3rd, 4th, 5th, 6th, 7th and 8th Defendants until trial or further order.
2. The injunction order granted on 14th February 2007 against all Defendants will continue until trial or further order made by the Court.
3. The 1st and 2nd Defendants shall file and serve an affidavit setting out all evidence and information put before the Court on 27th February 2007 and all other matters which the 1st and 2nd Defendants want the Court to consider by close of business Tuesday, 6th March 2007.
4. The Claimants shall file and serve a reply to the affidavit filed by the 1st and 2nd Defendants by close of business Tuesday, 13th March 2007.
5. The further hearing of this application is adjourned to Monday 16th April 2007, subject to paragraph 6 below.
6. All parties have liberty to apply to vary or rescind this order on not less than 24 hours' notice in writing (including by email) to all parties. In particular, the 1st and 2nd Defendants have liberty to apply to vary or rescind this order anytime after 13th March 2007.
7. The costs of this application are reserved.
