UPON reviewing the Claimant’s Application Notice CFI-002-2017/10 dated 3 March 2019 seeking an order for an extension of time to file and serve its Reply to the First Defendant’s defence; and an order for production
AND UPON reviewing the Defendant’s response to the Application dated 7 March 2019
AND UPON reading the relevant material in the case file
IT IS HEREBY ORDERED THAT:
1.Pursuant to RDC 16.18, the Claimant’s application for an extension of time to file its Reply to the First Defendant’s Defence is granted and paragraph 2 of the Consent Order dated 20 December 2018 shall be varied to read 28 March 2019.
2. Pursuant to RDC 28.6, the Claimant’s application for production of documents referred to in the First Defendant’s Defence is granted, and the First Defendant shall provide the Claimant with copies of each of the documents referred to in Appendix A of the Claimant’s letter dated 19 February 2019 no later than 7 days from the date of this Order.
3. The parties shall have liberty to apply.
4. Costs shall be costs in the case.
