UPON reviewing the Court file
AND UPON reviewing the Rules of the DIFC Courts
AND UPON the order of Justice Roger Giles dated 18 February 2020
AND UPON review of the Application of the First Defendant and the Application of the Second and Third Defendants with the witness evidence filed therewith on 19 February 2020 (“the Applications”)
AND UPON hearing counsel for the First and Second and Third Defendants and Mr Kalani on behalf of the Claimant at a hearing on 23 February 2020
IT IS HEREBY ORDERED THAT:
(1) The Claimant’s claims against the Defendants are struck out.
(2) Judgment shall be entered for the First, Second and Third Defendants.
(3) The Claimant shall pay the First and Second and Third Defendants’ costs of the claim, to be the subject of detailed assessment if not agreed.
(4) The Claimant shall pay the Defendants’ cost of the Applications in the amounts of:
(4.1) USD 20,000 to the First Defendant; and
(4.2) USD 12,000 to the Second and Third Defendants.
(5) The Part 21 claim shall consequently be dismissed with any issue as to the costs of that claim being reserved.
