UPON the Claimant’s application for an interim injunction dated 12 January 2021 (the “Application”)
AND UPON the Claimant indicating to the Court that it believes that the Application is urgent and the timetable for a heavy application at Rule 23.46 of the Rules of the DIFC Court (“RDC”) should be abridged pursuant to RDC 23.47 but that it is nonetheless appropriate in all the circumstances for the Respondent to be provided with a short opportunity to file and serve evidence in response to the Application, and to be given notice of the hearing
AND UPON the Court’s direction that the Claimant set out its reasons for requesting an abridgement of time in an affidavit or witness statement and provide a proposed draft procedural order (“Draft Order”)
AND UPON the Court reading the first witness statement of Waseem Khokhar, Partner at Reed Smith LLP dated 14 January 2021 requesting an abridgement of the timetable for the determination of the Application
AND UPON the Registrar’s email direction to the Claimant’s solicitors, sent at approximately 4.15pm on 14 January 2021
AND UPON the Defendant’s email to the Registrar sent at approximately 2.10pm on 17 January 2021 confirming his agreement with the Claimant’s Draft Order
IT IS HEREBY ORDERED THAT:
1. The timetable for the Application is abridged pursuant to RDC 23.47.
2. The Respondent must file and serve its evidence in answer to the Application by 4pm 21 January 2021.
3. The Claimant shall file and serve evidence in reply (if any) as soon as possible, and in any event by 4pm 24 January 2021.
4. The Application shall be heard at 11am on 28 January 2021 or such other time convenient to the Court.
