ORDER OF THE REGISTRAR MADE ON 4 FEBRUARY 2010

 

UPON reading the Applicants'/Claimants' Part 8 Claim Form dated 25 January 2010;

 

AND UPON reading the Applicants'/Claimants' Application Notice dated 25 January 2010 requesting that Peter Richard Evans can sign the statement of truth in the Claim Form on behalf of all the Applicants/Claimants (the "Application");

 

AND UPON reading the First Witness Statement of Peter Richard Evans dated 25 January 2010;

 

AND UPON hearing Mr C.W. Gambrill as counsel for the Applicants;

 

AND UPON reviewing Rule 22.8 of the Rules of the DIFC Courts;

 

AND UPON there being no appearance on behalf of the Respondent;

 

IT IS ORDERED THAT:

 

1. The Application is dismissed.

 

2. Should the Applicants wish to pursue the matters set out in the Application, they shall:

 

(a) file and serve evidence of Peter Richard Evans' authority to sign a statement of truth on behalf of all the Applicants along with a new Application Notice;

 

(b) file and serve an amended Claim Form in which the statement of truth is to be signed by the Applicants' legal representative(s); or

 

(c) with the agreement of the Respondent/Defendant, file a separate document complying with Rule 22.3 containing a statement of truth verifying the facts contained in the Claim Form, signed by the Applicants or their legal representative(s)
on or before 11 February 2010.

 

3. There is no order as to the costs of and incidental to the Application
