AND UPON hearing counsel for the Claimants and the Defendant

IT IS ORDERED THAT

Production of Documents

1. Each party to make standard disclosure by documents to the other party, pursuant to RDC 28.6 by 4pm Tuesday, 28 May 2013 ("Standard Disclosure").

 

2. Any Request by a party pursuant to RDC 28.13 for specific production of documents is to be filed and served by 4pm Tuesday, 11 June 2013 ("Request to Produce").

 

3. Documents responsive to a Request to Produce or objections thereto pursuant to RDC 28.16 and 28.42, are to be served by 4pm Tuesday, 18 June 2013.

 

4. Where objections to any Requests to Produce1 have been made, the Court will determine those objections and will make any disclosure order within the following [7] days and in any event not later than 4pm, Tuesday, 25 June 2013. [RDC 28.20]

 

5. The parties shall comply with the terms of any disclosure order within [14] days thereafter and in any event not later than 4pm, Tuesday, 9 July 2013. [RDC 28.22]

 

6. Where there are no objections to a particular Request contained in a Request to Produce, documents responsive to that request shall be produced within [7] days from the date of the Request to Produce, and in any event not later than 4pm, Tuesday, 25 June 2013. [RDC 28.15]

Witness Statements of Fact

7. Witness Statements of Fact upon which the parties seek to rely are to be exchanged by Tuesday, 23 July 2013.

 

8. Supplementary Witness Statements of fact responsive to the statements at paragraph nine to be exchanged by no later than Tuesday, 6 August 2013.

Expert Reports

9. Claimants' Expert Surveyor Reports to be served by no later than 6 August 2013.

 

10. Defendant's Expert Surveyor Report to be served by no later than 3 September 2013.

 

11. Parties' experts to meet by no later than 17 September 2013 and to file Supplemental Report listing areas of agreement and disagreement by 1 October 2013.

Pre-Trial Review

12. A Pre-Trial Review is to be fixed for 10 October 2013.

Trial

13. Trial is to be listed for 8 December 2013 with a 3 day time estimate.

Miscellaneous

14. Costs in the case.
