UPON the Freezing Order of Justice Sir Jeremy Cooke dated 14 January 2021
AND UPON the Order of Justice Sir Jeremy Cooke dated 24 January 2021
AND UPON reviewing the relevant documents on the Court’s file
AND UPON hearing counsel for the Applicant and counsel for the Respondent at the hearing of 27 January 2022.
IT IS HEREBY ORDERED THAT:
1. By close of business on 31 January 2022, the Respondent shall provide the Claimant with a copy of the most recent register of the shareholders and directors of the Respondent in their possession.
2. Within 7 days of the date of this Order the Respondent will provide to the Claimant all documents in existence since 31 August 2020 in relation to changes to the shareholdings and directorships of the Respondent.
3. Within 7 days of the date of this Order, the Respondent shall file affidavit(s) evidence from Mr Ahmed Abouhashima and any other individuals or legal entities (where appropriate), in relation to all changes to the shareholdings, directorships and control of the Defendant.
4. Within 7 days of the date of this Order, the Claimant shall file any further application for contempt that it wishes to make against other individuals together with supporting evidence.
5. The Parties shall liaise after the expiry of 7 days and the exchange of evidence referred to above and shall seek to agree directions for the future course of the proceedings. If no agreement is reached within 3 working days thereafter, the Parties shall refer the matter to the Court with submissions in writing as to the further directions to be given.
