AND UPON reading the Order of the Registrar Nour Hineidi dated 6 December 2021 setting out the procedural timeline of the Application and ordering the Claimants to file affidavits in response to the Application
AND UPON reviewing the Claimants’ affidavits filed and served on 14 December 2021
AND UPON reviewing the Defendant’s evidence in reply dated 4 January 2022
AND UPON hearing counsel for the Defendant and counsel for the Claimants at a hearing on 13 January 2022
AND UPON the Order of Justice Roger Giles dated 17 January 2022 requiring that the Claimants file and serve further affidavits (“January Order”)
AND UPON reviewing the Claimants’ affidavits filed and served pursuant to the January Order dated 21 January 2022
AND UPON the Application being re-listed pursuant to paragraph 2 of the January Order for submissions on costs
AND UPON hearing counsel for the Defendant and counsel for the Claimants at a further hearing on 16 February 2022
IT IS HEREBY ORDERED THAT:
1. The Claimants do pay the Defendant’s costs of, and incidental to, the Application, summarily assessed in the sum of AED 400,000, within 14 days of the date of this Order.
