And

IN THE MATTER OF DIFC INSOLVENCY LAW NO 7 OF 2004

WINDING UP ORDER

UPON reading the petition of Forsyth Partners (Middle East) Limited ("the Company"),

AND UPON hearing counsel for the Company,

AND UPON the Court accepting the undertaking of Counsel for the Company to file a supplementary witness statement from Mr Paul Forsyth verifying his statement that the telephone meeting referred to at Exhibit "B" of his first witness statement was duly convened in accordance with the Company's articles,

AND UPON the Court accepting the undertaking of the Company that it will advise all known creditors within 48 hours of the fact that this winding up order has been made,

IT IS ORDERED THAT:

1. The Company be wound up by the Court under the provisions of the DIFC Insolvency Law No 7 of 2004;

 

2. Steven John Akers and David John Dunkley, of Grant Thornton UK LLP, of Grant Thornton House, 22 Melton Street, Euston Square, London, NW1 2EP, be appointed as joint liquidators in respect of the Company, pursuant to Article 58 of the DIFC Insolvency Law 2004;

 

3. The Company is excused from any obligation under regulation 5.3 of the DIFC Insolvency Regulations to advertise the petition.

 

4. All creditors of the Company have liberty to apply to the Court within 7 days for the terms of the winding up order to be varied.
