(a) the Application Notice filed by the Claimant on 22 March 2009 and the Tenth Statement made by the Claimant dated 22 March 2009.
(b) the Request for Judgment in Default filed with the DIFC Courts' Registry on 25 March 2009 and the Evidence in Support filed by the Claimant.
(c) the Second Statement of Adrian Chadwick dated 19 April 2009 made on behalf of the Defendant.
(d) the Fourteenth Statement made by the Claimant dated 20 April 2009 comprising the Claimant's Evidence in Reply.
AND UPON hearing the Claimant in person and Mr Adrian Chadwick, Counsel for the Defendant.
IT IS ORDERED as follows:
1. The Application made by the Claimant on 22 March 2009 is dismissed.
2. The Request for Judgment in Default filed with the DIFC Courts' Registry on 25 March 2009 is dismissed.
3. The Defendant's costs of and occasioned by (a) the Claimant's Application dated 22 March 2009 and (b) the Claimant's request for Judgment in Default filed on 25 March 2009 are to be assessed by the DIFC Courts' Registrar, sitting as a Taxing Master, on a date to be fixed and the assessed costs be paid by the Claimant to the Defendant.
