CONSENT ORDER
FURTHER TO the Judgment of the Small Claims Tribunal of H.E. Justice Shamlan Al Sawalehi dated 23 February 2015;
AND UPON the Appellant’s Notice for permission to appeal (the “Application”) dated 9 March 2015;
AND UPON the Application being granted by H.E. Justice Omar Al Muhairi on 11 March 2015;
IT IS HEREBY ORDERED BY CONSENT THAT:
1. The appeal hearing scheduled for Thursday, 2 April 2015 before H.E. Justice Omar Al Muhairi be stayed until Thursday, 16 April 2015.
2. The Appellant/Paying Party shall pay the Respondent/Receiving Party the amount of AED 47,981.65 (forty seven thousand, nine hundred and eighty one dirhams and sixty five fils) (“Settlement Sum”) in full and final settlement of the Respondent’s claim by no later than 4pm on Wednesday, 8 April 2015.
3. The Appellant/Paying Party shall pay the Settlement Sum by way of Bank transfer to the Respondent/Receiving Party in accordance with the bank details provided at Annex 1 to this Order.
4. Upon receipt of the Settlement Sum by the Respondent/Receiving Party, the Respondent/Receiving Party shall notify the Registry that the matter should be discontinued and the Registry shall issue a Certificate of Discontinuance thereafter.
5. There be no order as to costs.
