AMENDED CASE MANAGEMENT ORDER OF H.E. JUSTICE ALI AL MADHANIUPON the parties having agreed in writing the Directions below;
AND UPON the parties having agreed on the 13 November 2012, to amend the date of submission in numbered paragraph 7;
IT IS HEREBY ORDERED BY CONSENT that:
Disclosure
1. Standard disclosure is to be made by 1 August 2012.
2. In respect of specific disclosure, each party will serve on the other party a Request to Produce pursuant to the Rules of the
DIFC Courts ("
Rules") RDC
28.13 and
28.14 by
Thursday, 15 August 2012.
3. By Thursday, 6 September 2012, each party to whom a Request to Produce is addressed shall produce to the other party such of the documents requested that are in its possession, custody or control in respect of which it does not make any objections.
4. Each Party shall serve its objections to the Request to Produce, where applicable, by
Thursday, 6 September 2012 in accordance with
RDC 28.16 and
RDC 28.42.
5. Any party to whom any objections are addressed shall serve its response to such objections by Thursday, 13 September 2012.
6. Any application for a Disclosure Order pursuant to
RDC 28.20 shall be made by
Thursday, 20 September 2012.
Witness
7. Signed statements of witnesses of fact, and hearsay notices where required by
RDC 29.104, are to be exchanged by
20 November 2012.
8. Unless otherwise ordered, witness statements are to stand as the
evidence in chief of the witnesses at trial.
9. The Defendant is granted leave for one of its factual witnesses to have an interpreter present during the giving of his evidence, where required.
Trial
10. The trial of this matter is to take place on 23 January 2013 with an estimated duration of two days.
11. Proposals for trial bundles are to be provided by the Claimant to the Defendant by not later than 21 days before trial, and preparation of trial bundles are to be completed and
served by the Claimant by not later than 14 days, before trial in accordance with
Part 35 of the Rules.
12. Not less than 10 days before the date of the first day fixed for the trial of the claim, the Claimant shall provide a draft chronology to the Defendant. The Claimant and the Defendant shall agree the chronology and file the chronology with the
Registry of the
Court not less than five days before trial.
13. Skeleton arguments shall be exchanged and filed with the Registry of the Court not later than five days before trial.
Liberty to apply
14. There be liberty to apply for further directions.
