UPON reviewing the Second Defendant’s Appeal Notice dated 13 March 2018 seeking permission to appeal against the Order of H.E. Justice Ali Al Madhani dated 11 March 2018 and the Judgment of H.E. Justice Ali Al Madhani dated 21 March 2018 (the “Original Orders”)
AND UPON reviewing the Appellant’s Grounds of Appeal dated 25 March 2018
AND UPON reviewing the Claimant’s submissions dated 29 March 2018 in opposition to the Appellant’s application for permission to appeal
AND UPON reviewing all relevant material in the case file
AND in accordance with Part 44 of the Rules of the DIFC Courts (“RDC”)
IT IS HEREBY ORDERED THAT permission to appeal against the Order of H.E. Justice Ali Al Madhani dated 11 March 2018 and the Judgment of H.E. Justice Ali Al Madhani dated 21 March 2018 be granted as the requirements of RDC 44.19 have been met on the grounds that there is a compelling reason why the appeal should be heard, namely that the original Orders were granted in circumstances of urgency which merit a second look whether those Orders were appropriate in the circumstances of the case.
