CONSENT ORDER
UPON the Applicant’s without notice Application dated 28 January 2021 seeking interim relief in the form of an injunction against the Respondents
AND UPON hearing counsel for the Applicant at an ex parte hearing on 31 January 2021
AND UPON the issue of the order for injunctive relief of Justice Roger Giles on 31 January 2021 (the “Order”) specifying a Return Date of 3 February 2021
AND UPON the parties having agreed to postpone the Return Date of 3 February 2021 in accordance with Rule 25.29 of the DIFC Court Rules to 18 February 2021
AND UPON the parties having further agreed to vacate the postponed Return Date of 18 February 2021 and that the Order shall continue in force until further order
AND UPON the Defendants’ Application dated 30 March 2021 seeking discharge of the Order (the “Discharge Application”)
AND UPON the parties having further agreed that the “heavy” application timetable be adopted for the Discharge Application
AND UPON the Discharge Application having been served on the Claimant on 6 April 2021 and the Claimant having filed and served the evidence in answer to the Discharge Application after 4 pm on 4 May 2021
AND UPON the Claimant’s Application by letter dated 5 May 2021 seeking a retrospective extension of time for the filing and service of the evidence in answer to the Discharge Application (the “Extension Application”)
AND UPON the parties having further agreed that the Extension Application be granted
AND UPON the parties having further agreed an extension of time for the Defendants to file their evidence in reply until 25 May 2021
AND UPON the documents recorded on the Court’s file
IT IS HEREBY ORDERED BY CONSENT THAT:
1. The “heavy” application timetable be adopted for the Discharge Application.
2. The Extension Application is granted.
3. The time for filing of the Claimant’s evidence in answer to the Discharge Application is extended, retrospectively, to 10 am on 5 May 2021.
4. The evidence in answer to the Discharge Application is considered to be filed and served in time.
5. The Defendants’ evidence in reply (if any) must be filed and served by 25 May 2021.
6. There be no order as to costs.
