UPON reading the Application Notice and evidence filed by the Defendant on 28 September 2009
UPON reading the letter dated 7 October 2009 filed by the Claimant in response to the Application
UPON hearing counsel for the Defendant and for the Claimant
IT IS ORDERED as follows:
1. The claim and these proceedings be dismissed/struck out and judgment entered for the Defendant.
2. The Claimant may not supply a copy of any documents relating to these proceedings to any third party save for the purpose of obtaining legal advice without permission of the Court.
3. A non-party may not obtain a copy of any document from the Court records relating to this case without the permission of the Court to be obtained an application made in accordance with RDC Part 23 on notice to the Defendant. The hearing of any such application shall be in private.
4. All issues relating to the costs of these proceedings are adjourned to a date to be fixed, reserved to Justice Sir Anthony Colman.
