ORDER OF DEPUTY CHIEF JUSTICE SIR ANTHONY COLMAN MADE ON 30 SEPTEMBER 2010
UPON hearing counsel for the Appellant;
AND UPON hearing the representative of the Respondent
IT IS HEREBY ORDERED THAT:
1. The Appeal to be stood out of the list.
2. Appellant to, by 12 October 2010 (being 14 days from the date of this Order), file with the Court and serve on the Respondent their case on the capacity of the former CEO of the Appellant to have commenced this Appeal on 27 June 2010.
3. Respondent to, by 2 November 2010 (being 21 days thereafter), to file with the Court and serve on the Appellant their reply to the Appellant's case as set out at paragraph 2 above.
4. The Appeal to be restored to the Court of First Instance (sitting as Appeal Court to the DIFC Courts Small Claims Tribunal) for listing of a hearing on the matters set out at paragraphs 2 and 3 above.
5. Appellant to pay Respondent's costs of the hearing on 28 September 2010, if any, in any event.
