ORDER OF JUSTICE SIR JOHN CHADWICK
UPON hearing the Petitioner, Peter Gray, appearing in person, counsel for the Defendant and Counsel for the Provisional Liquidator, on 4 June 2012, and reading the Petition
IT IS ORDERED THAT:
The hearing of Monday 4 June 2012 shall be adjourned to 10am on Monday, 18 June 2012 on the following terms:
1. The Petitioner shall forthwith re-advertise that the petition shall be heard on this date 18 June 2012.
2. The advertisement shall specifically state that any person intending to appear at the hearing shall give to the Petitioner, the Provisional Liquidator and Al Tamimi & Co, on behalf of the Defendant, notice of his intention, specifying whether or not he intends to support or oppose the petition, and whether or not he objects to the appointment of the Mr Shahab Haider as the Provisional Liquidator, by no later than
4pm on Sunday, 17 June 2012, and that if no such notice is provided, then he shall not be able to appear at the hearing of the petition listed for
18 June 2012 without further order of the
Court.
3. The costs of the aforementioned advertisement to be paid by the Petitioner.
4. If no notice of objection has been received by 4pm on 17 June 2012, a Winding up Order shall take effect on 18 June 2012 without the need for the attendance at a hearing
and Mr Shahab Haider of Sajjad Haider Chartered Accountants LLP shall be appointed as Liquidator with immediate effect from that date, 18 June 2012.
5. If a notice of objection is filed, the Petitioner shall attend the hearing on 18 June 2012.
