UPON reviewing the Claimant’s application for a Document Production Order dated 31 January 2022 (the “Claimant’s Application”)
AND UPON reviewing the First Witness Statement of Ms. Kimia Kalantarian dated 31 January 2022
AND UPON reviewing the Defendant’s response to the Claimant’s Application dated 7 February 2022 (the “Defendant’s Response”)
AND UPON reviewing the Claimant’s replies to the Defendant’s Response dated 14 February 2022
AND UPON being satisfied that the categories of documents the subject of the Claimant’s Application are:
a) relevant and material to issues in the case;
b) adequately and sufficiently defined;
c) within an appropriate date range
IT IS HEREBY ORDERED THAT:
1. By no later than 4pm on 14 March 2022 the Defendant shall:
a) search for and produce any documents not subject to legal professional privilege falling within the categories specified in Requests Nos. 1, 2 and 3 in the Claimant’s Redfern Schedule; and
b) provide a Document Production Statement in the form set out in Schedule B to Part 28 of the RDC in respect of the documents referred to in sub-paragraph (a) above.
