CONSENT ORDER
UPON the Default Judgment of H.E. Justice Maha Al Mheiri having been issued against the Defendant on 10 January 2023 (the “Default Judgment”)
AND UPON the Defendant’s Application No. CFI-020-2022/1 dated 22 November 2023 to set aside the Default Judgment (the “Set Aside Application”)
AND UPON the Claimant’s Application No. CFI-020-2022/2 dated 21 December 2023, filed on a protective basis, for an extension of time in which to file its evidence in answer to the Set Aside Application (the “EOT Application”)
AND UPON the parties agreeing to the terms of this Consent Order
IT IS HEREBY ORDERED BY CONSENT THAT:
1. The Claimant shall file and serve its evidence in answer to the Set Aside Application by no later than 4pm GST on 8 January 2024.
2. The Defendant shall file and serve her evidence in reply on the Set Aside Application (if any) by no later than 4pm GST on 22 January 2024.
3. The Parties shall submit the Case Bundle, and file and exchange their Skeleton Arguments as well as any documents to be relied on during the course of the hearing of the Set Aside Application, by no later than 4pm GST on 29 January 2024.
4. The hearing of the Set Aside Application is listed at10am GST on 5 February 2024 before Justice Andrew Moran.
5. There shall be no order as to costs in relation to the EOT Application.
