UPON the Claimant’s Notice of Commencement of Assessment of Bill of Costs dated 19 September 2024 (the “NOC”)
AND UPON the Defendant’s failure to file its Points of Dispute, pursuant to Rule 40.15 of the Rules of the DIFC Court (the “RDC”), within 21 days from the date of service of the NOC
AND UPON the Claimant’s request for a Default Costs Certificate dated 14 October 2024 (the “Request”) pursuant to RDC 40.17
AND UPON reviewing all other relevant case documents filed in this matter
IT IS HEREBY ORDERED THAT:
1. The Request is granted.
2. The Defendant is ordered to pay the Claimant a total of AED 40,534.55 (the “Amount”) within 21 days from the date of this Order, comprising:
(a) AED 36,135.08 being the amount set out in the NOC;
(b) AED 2,710.12 being the filing fee for the NOC;
(c) AED 1,101.75 being the filing fee for the Default Costs Certificate; and
(d) AED 587.60 in costs payable to the Claimant for the commencement of detailed assessment proceedings, pursuant to RDC 40.22.
3. In the event the Defendant does not pay the Amount within 21 days from the date of this Order, interest at the rate of 9% per annum, pursuant to Practice Direction No. 4 of 2017 (Interest on Judgments), will accrue on the Amount from the date of this Order until the date of full payment.
