AND UPON the Order of Justice Lord Angus Glennie dated 16 August 2024 (i) granting the Claimant permission to amend its past and future statements of case to reflect the amended Defendant’s name; and (ii) for the Defendant to grant the Claimant access to the ePMS Software by no later than 4pm on 26 August 2024 (the “16 August Order”)
AND UPON the parties’ email correspondence with the Registry dated 5 and 6 September 2024 to re-schedule the Pre-Trial Review listed for 9 September 2024 (the “PTR”) to a later date
AND UPON the PTR being vacated to be listed to a later date
AND UPON the trial of this claim being listed for 14 to 15 October 2024 (the “Trial”)
AND UPON the Claimant’s Application No. CFI-020-2023/5 dated 25 September 2024 seeking an unless order compelling the Defendant’s compliance with the 16 August Order and imposing sanctions upon the Defendant for its failure to comply with the 16 August Order (the “Unless and Sanctions Application”)
AND PURSUANT TO Rule 4.12 of the Rules of the DIFC Courts
IT IS HEREBY ORDERED THAT the Trial shall be vacated pending determination of the Unless and Sanctions Application.
