UPON the Claimant’s Application No. CFI-020-2023/4, dated 30July 2024 (the “Application”), seeking the Court’s permission to amend the Claim Form, and thereby all other past and future statements of case in (i) these Proceedings, (ii) ENF-139-2024, and (iii) ENF304-2023 (together with ENF-139- 2024, the “Associated Applications”), to reflect the correct name and contact details of the Defendant, pursuant to RDC r.18.2 (the “Permission to Amend”)
UPON the Application seeking an order (i) mandating the Defendant to grant the Claimant access to the ePMS software, which is the subject of these Proceedings, and to which the Claimant previously had access in accordance with the Cooperation Agreement dated 30 June 2024 (the “Software”), pursuant to RDC r.4.2(14)
UPON the Application seeking an order affording the Parties an extension of time to file and serve their Expert Reports and Supplemental Expert Reports
UPON the Court considering the witness statement of Mr. Amr Bajamal on behalf of the Applicant, dated 29 July 2024
AND UPON the Court considering the attached Claim Form with the proposed amendments (the “Amended Claim Form”)
IT IS HEREBY ORDERED THAT
1. The Application is granted.
2. Permission to amend is granted and all past and future statements of case, as well as other relevant documentation and records, in these Proceedings and the Associated Applications, shall be amended to reflect the Defendant’s name and contact details as follows:
(a) The Defendant’s name: Belsons Innovations Technologies LLC
(b) The Defendant’s address: Bur Dubai, Al Quoz Industrial Area 2, Emirates Hills, Dubai
(c) The Defendant’s email address: hamza.b@belsons.com
3. The Defendant shall grant the Claimant access to the Software by no later than 4pm on 26 August 2024 (the “Grant of Access”).
4. The time for the Parties to file and serve any Expert Reports shall be extended to within 14 days of the Grant of Access (the “Deadline to file Expert Reports”).
5. The time for the Parties to file and serve any Supplemental Expert Reports shall be extended to within 14 days of the Deadline to file Expert Reports.
6. The Registry shall, upon the Defendant’s compliance with paragraph 3 above, revise the timeline set out in the Case Management Order, dated 10 May 2024, accordingly.
7. The Defendant shall pay the Claimant’s costs of this Application to be assessed by the Registrar if not agreed by the Parties.
