ORDER OF JUSTICE WAYNE MARTIN
UPON the Court directing, by Order of the Deputy Registrar Nour Hineidi dated 9 June 2020, that there shall be a trial limited to issues of liability and injunctive relief only (the “Liability Trial”) listed in the DIFC Court of First Instance between 6 and 10 September 2020 (the “CMC Order”)
UPON hearing Counsel for the Claimants and the Defendants at the hearing on 9 August 2020
AND UPON the parties confirming that the case management directions below are agreed
IT IS HEREBY ORDERED THAT:
1. The Liability Trial be adjourned, to take place in the DIFC Court of First Instance from 13 to 24 December 2020, with a time estimate of 10 days.
2. The CMC Order be varied as follows:
(a) [By 4pm on 18 August 2020], the parties shall file and exchange witness statements limited to the issues of liability and injunctive relief.
(b) [By 4pm on 1 October 2020 –], the parties shall file and exchange reply witness statements.
(c) Parties to agree the trial bundle index by 4pm on 26 October 2020. The Claimants shall provide a copy of the trial bundle to the Defendants by 4pm on [9] November 2020, and shall file the trial bundle at Court by 4pm on [30] November 2020.
(d) The parties shall file and exchange skeleton arguments by 4pm on [2] December 2020.
3. The dates of 9 and 10 September 2020 will be reserved for a CMC hearing. In that regard:
(a) The parties are to issue and serve any applications to be heard at the CMC / applications hearing by 4pm on 26 August 2020.
(b) Any evidence in response to such applications is to be filed and served by 4pm on 3 September 2020.
(c) The parties shall file and exchange skeleton arguments by 4pm on 6 September 2020.
4. Liberty to apply.
5. The parties may agree in writing to vary the dates for compliance with these directions by up to 14 days without the need to apply to the Court provided that the variation does not jeopardise the trial date.
6. Costs in the case.
