UPON HEARING Ms F. Campbell for the Defendant/Applicant and Ms L. Riesenburg for the Claimant/Respondent on 2 May 2012 in relation to the Defendant's Application Notice dated 22 February 2012 Application No. 5/2012

AND UPON reading the documents recorded on the Court file as having been read

AND UPON judgment of the Application being granted in favour of the Defendant/Applicant on 5 July 2012

AND UPON reading the further submissions made on behalf of the parties in relation to costs

AND UPON the Defendant's/Applicant's subsequent Application Notice dated 27 September 2012 pertaining to costs of consequent upon the Judgment

IT IS ORDERED THAT:

1. The Claimant shall pay forthwith to the Defendant all of its costs of and caused by the Application and of those parts of the proceedings to which the Judgment relates, being the costs of the case to date, save only for costs of the surviving claims for money for alleged wrongful termination of employment more particularly described in paragraph 58.1 and 58.2 of the Particulars of Claim and for costs of the Counterclaim, which excepted costs shall continue to be costs in the case.
2. The Defendant's costs hereby ordered shall be subject to a detailed assessment on the standard basis, if not agreed, and the Defendant shall be entitled to commence the detailed assessment procedure immediately in accordance with RDC Part 40.
