UPON reviewing the Applicant/Defendant’s Application No. CFI-023-2017/3 dated 11 April 2018 seeking an order that:
i. The Court strike out the particulars of claim pursuant to Rules 4.16 and 4.2(14) of the Rules of the DIFC Courts;
ii. Immediate judgment be issued against the Respondent/Claimant pursuant to Rule 24.1(a) of the Rules of the DIFC Courts; and
iii. The time for the Applicant/Defendant to file and serve its defence be stayed until the outcome of the Application is determined by the Court pursuant to Rule 4.2(6) of the Rules of the DIFC Courts.
AND PURSUANT TO Rule 4.2(6) of the Rules of the DIFC Courts and on proper application of the Court’s case management principles
IT IS HEREBY ORDERED THAT:
1.The time for the Applicant/Defendant to file and serve its defence is stayed pending the outcome of the Application.
2. Costs in the case.
