UPON the Order of H.E Justice Shamlan Al Sawalehi issued on 1 October 2020 (the “Order”)
AND UPON the Defendant’s Application filed on 7 October 2020 seeking permission to file a counterclaim (the “Counterclaim Application”)
AND UPON the Defendant’s Appeal Notice filed on 19 October 2020 seeking permission to appeal the Order of H.E Justice Shamlan Al Sawalehi issued on 1 October 2020 (the “Application for Permission to Appeal”)
AND UPON reviewing the relevant documents on the Court’s file
IT IS HEREBY ORDERED:
1. The Counterclaim Application is dismissed for the reasons given in paragraphs [26] to [31] of the Order (in which a substantially identical application was dismissed).
2. The Application for Permission to Appeal is granted on the basis that there is a compelling reason why the appeal should be heard.
