UPON the Case Management Order of H.E. Justice Nassir Al Nasser 18 July 2021 (“CMC Order”) as varied, most recently by the Consent Order dated 28 December 2021
AND UPON the Application No. CFI-025-2020/10 and Second Witness Statement of Defendant No. 5 (“D5”) for self and representing Defendant No. 2 (“D2”) dated 14 November 2021, the Order of Justice Lord Angus Glennie dated 27 December 2021 (“December Order”)
AND UPON the request of D2 and D5 to file and submit the Expert’s Affidavit on 21 January 2022
AND UPON the Court having read the papers marked in the Court file as having been read
AND UPON the Court reviewing the Rules of the DIFC Courts (“RDC”) and the Court being satisfied that it may exercise its powers pursuant to RDC r.4.2 further vary the CMC Order and the December Order in accordance with the parties’ agreement
AND UPON the parties having agreed to the vary the terms of the December Order
IT IS HEREBY ORDERED BY CONSENT THAT:
1. The deadline in paragraphs 2 of the December Order is varied to 4pm on Friday 21 January 2022.
2. Costs in the case.
