IT IS HEREBY ORDERED BY CONSENT THAT:
Production of Documents
1. Standard and requested production of documents to be made by each party on or before 23 December 2012 and the Defendant to respond to the Claimants Request for Clarification/Further Information by the same date.
Witness Statements
2. Signed statements of witnesses of fact, a maximum of four on behalf of each party, to be exchanged by both parties not later than 8 April 2013.
Expert Reports
3. The parties shall have leave to call one expert in the field of delay analysis.
4. The Claimants, should they decide to file an Expert Report, shall file and serve any Expert Report not later than 15 April 2013.
5. The Defendant, should they decide to file an Expert Report, shall file and serve any Expert Report not later than 22 April 2013.
6. In the event that both parties submit an Expert Report the experts shall meet to discuss their respective reports by 28 April 2013.
7. In the event that both parties submit Expert Reports the experts shall submit a Joint Experts Report setting out the matters on which they are and on which they are not agreed and this Joint Experts Report is to be filed and served by 2 May 2013.
Progress Monitoring Date
8. The parties are to file an agreed trial timetable by 12pm on 2 May 2013.
9. The parties are to file and serve respective Progress Monitoring information sheet (
RDC 26.61) by
12pm on 2 May 2013.
10. The parties are to file and serve respective Pre-trial checklists (
RDC 26.65) by
12pm on 2 May 2013.
11. The Case Progress Monitoring meeting be listed before the
Registrar at
10am on 5 May 2013.
Trial Bundles
12. Agreed trial bundles to be completed in accordance with
Part 35 of the RDC and lodged by not later than
4pm on 6 May 2013.
Trial
13. The trial is listed for two days, commencing at 10am on 13 May 2013.
14. Costs in the Case.
15. Liberty to apply.
