UPON reviewing the Court file;
AND UPON the Claimant's Application No. CFI 026-2012/1;
AND UPON reading the Case Management Bundle;
AND UPON hearing counsel for the Claimant and counsel for the Defendant;
IT IS HEREBY ORDERED THAT:
Request for Information and Reply
1. The Defendant to file and serve replies to the Claimant's Request for Further Information as set out in the attached Schedule ("RFIs") and/or draft amended Defence (if so advised) as soon as possible but no later than 5 November 2012.
2. The Claimant to file a Reply within 21 days of receipt of the Defendant's response to the RFIs and/or Amended Defence (whether by agreement or Court order).
Production of Documents
3. Each party to make standard disclosure of documents to the other party, pursuant to RDC
28.6, within 14 days of the Reply (
"Standard Disclosure").
4. Any Request by a party pursuant to RDC
28.13 for specific production of documents is to be filed and served within 14 days of Standard Disclosure (
"Request to Produce").
5. Documents responsive to a Request to Produce or objections thereto pursuant to RDC
28.16 and
28.42, are to be served within 21 days of Request for to Produce.
6. Any application by a party for specific disclosure pursuant to a Request to Produce is to be filed and served within 14 days of paragraph 5 above.
7. The hearing of any application for specific disclosure, in the event required, is to be listed for hearing on 11 February 2013 with a half day time estimate.
Witness Statements of Fact
8. Witness Statements of Fact upon which the parties seek to rely are to be filed and served within 28 days of the hearing at paragraph 7 or of further disclosure, whichever is later.
9. Supplementary Witness Statements of Fact responsive to the statement at paragraph 8, if required, are to be filed and served 14 days later.
Justice by Reconciliation
10. Within seven days following the exchange of Supplementary Witness Statements of fact as set out in paragraph 9, the parties to consult on whether some form of Justice by Reconciliation would be appropriate.
11. Any Justice by Reconciliation process agreed between the parties to take place by no later than 21 days after exchange of Supplementary Witness Statements of Fact.
Pre-Trial Review
12. A Pre-Trial Review is to be fixed for hearing at 2pm on 5 May 2013.
Trial
13. Trial is to be listed for 9 June 2013 with a 5 day time estimate.

14. Costs in the case.
15. Liberty to apply.
