FURTHER TO the Defendant’s Application CFI-026-2017/5 (the “Defendant’s Application”) filed on 22 February 2018 seeking a stay of proceedings pending the determination of the Defendant’s Application made to the Joint Judicial Committee. (the “JJC Application”), which according to Article 5 of the Decree serves as an automatic stay to the proceedings
AND UPON the JCC rejecting the Defendants’ Application and maintaining the proceedings before the DIFC Courts.
AND UPON reviewing the request made by the Claimant on 1 August 2018 for a default judgment pursuant to rule 13.4 of the Rules of the DIFC Courts (the “Claimant’s Application”)
AND UPON reviewing the case file
IT IS HEREBY ORDERED THAT:
1. The Claimant’s Application is denied as the automatic stay to the proceedings has been lifted on 11 July 2018 and the deadline to file a defence is deemed to be Wednesday, 8 August 2018.
2. Costs in the case.
