CONSENT ORDER
UPON the Claimant's Application No. CFI-027-2017/1 dated 14 February 2018
AND UPON reviewing the Court file
AND UPON reviewing the correspondence between the parties
IT IS HEREBY ORDERED BY CONSENT THAT:
1.Pursuant to the Court's inherent Case Management Powers under RDC 4.2(14), the Documents listed at Schedule 1 to this Order are ordered to form part of the Claimant's standard production under RDC 28.15.
2. The Claimant shall, within one (1) day of the date of the Order, produce to the Defendant the documents listed in Schedule 1 to this Order.
3. A confidentiality club is imposed around the use of the documents listed in Schedule 1 to this Order pursuant to RDC 28.65, such that:
(i) The documents produced under this Order are not to be disseminated without a further Order subject to the proviso that the Defendant may share these documents with lawyers instructed on behalf of the Defendant, their insurers and any witnesses of fact in the case or experts appointed or instructed by the Defendant in connection with their Defence of the Claim.
(ii) Before reading or referring to those documents at a hearing the party proposing to do so should invite the Court to consider whether an Order should be made under RDC 28.65 or that that part of the hearing should be held in private.
(iii) The following documents shall not be made available to any non-parties either under the general rules of the Court or upon an application by a non-party:
a. The statements of case, to the extent that they refer to the proceedings to which the documents produced under this Order relate;
b. The documents produced under this Order;
c. This Order including the attached Schedule 1;
d. Any correspondence between the parties and the Court in relation to this Order, save where such correspondence is shared with lawyers instructed on behalf of the Defendant, their insurers and any witnesses of fact in the case or experts appointed or instructed by the Defendant in connection with their Defence of the Claim.
4. Costs in the case.
