UPON application by the Defendant/Claimant by Counterclaim for an extension of time to complete the filing of submissions
AND UPON agreement of the Claimant/Defendant by Counterclaim to the same
AND UPON reviewing the Court’s file
IT IS HEREBY ORDERED BY CONSENT THAT:
1. The Defendant’s written closing submissions is due by 4pm on 23 September 2021
2. The Claimant’s written closing submissions is due by 4pm on 7 October 2021.
3. The Defendant’s final submissions in response to the Claimant’s closing submissions is due by 4pm on 14 October 2021.
4. The subsequent submissions should revert to being 14 and 21 days after the Defendant’s initial set of submissions (there now being no need for the additional 2 days for the submissions in response that the Defendant’s representative requested at the Trial).
5. The final round of submissions must be genuinely responsive only to newly raised points and not used as an opportunity to raise new points or to recast elements of the claim, which would inevitably prompt a request for permission to respond further.
