UPON hearing from Counsel for the Claimant and Defendant by Counterclaim and Counsel for the Defendant and Claimant by Counterclaim

AND UPON considering the evidence of and hearing from witnesses at the trial of this matter on 29 and 30 August, and 1 and 2 September 2021

AND UPON considering the written submissions following trial

AND UPON the interim judgment of the court dated 3 March 2020

AND UPON the issue of the written decision of the Court dated 6 April 2022

AND UPON the Order for a stay dated 25 May 2022

IT IS HEREBY ORDERED THAT:

1. The Defendant is entitled to payment of the amount of AED 110,000.00 for compensation in lieu of the remuneration that would have been received during the notice period of 30 days [para 168 of 6 April 2022 judgment].

2. The Defendant is entitled to payment of the amount of AED 338,800.00 for end of service gratuity [para 175 of 6 April 2022 judgment].

3. The Defendant is entitled to payment of the amount of AED 470,747.29 for vacation pay [para 183 of 6 April 2022 judgment].

4. Interest on the above sums is payable in the sum of AED 226.74 per day from 7 April 2022.

5. The Claimant has been granted a stay of the penalty sum set out in the judgment in the amount of AED 7,550,400.00 pending the outcome of Appeal CA-005-2022.

6. The Defendant is entitled to interest on the sum of AED 820,585.00 awarded under paragraph 5 of the Judgment dated 3 March 2020, in the amount of AED 71,532.54.

7. The Parties' costs for the Employment Claims and the Tort Claims to be dealt with by detailed assessment.

8. The Defendant’s claims for malicious prosecution and abuse of process have been dismissed.
