UPON the Claimant/Defendant by Counterclaim’s (the “Claimant”) Application Notice dated 17 October 2019
AND UPON the directions made by H.E. Justice Omar Al Muhairi on 1 October 2019, as amended on 2 October 2019, in respect of the timetabling of the Claimant’s application for third-party disclosure dated 24 September 2019 (the “Disclosure Application”)
IT IS HEREBY ORDERED THAT:
1.The following directions in respect of the Disclosure Application are vacated:
(a) the evidence in answer to the Disclosure Application is due by Tuesday, 22 October 2019; and
(B) the evidence in reply is due by Tuesday, 29 October 2019.
2. The hearing of the Disclosure Application listed at 10am on Wednesday, 13 November 2019 shall be adjourned to a date to be fixed by the DIFC Court.
3. The Claimant shall confirm within three business days after receiving the Defendant/Claimant by Counterclaim’s witness evidence in respect of the Disclosure Application whether it requires the Disclosure Application to be relisted for hearing or whether the Disclosure Application is withdrawn.
4. Costs in the case.
