UPON reviewing the Claimant/Defendant by Counterclaim's (the "Claimant") Application No. CFI-029-2018/5 dated 24 September 2019 seeking an order for Third Party Disclosure (the “Disclosure Application”)
AND UPON reviewing the documents and correspondence submitted by the parties as recorded onto the Court file
IT IS HEREBY ORDERED THAT:
1.The Disclosure Application is dismissed.
2. The Claimant pay the Third Respondent’s costs of and incidental to the Disclosure Application in accordance with Rule 38.65 of the Rules of the DIFC Courts.
3. The Third Respondent’s costs of and incidental to the Disclosure Application be immediately assessed in the sum of AED132,622.43 in accordance with RDC 38.28.
4. The Claimant pay the Defendant’s costs of and incidental to the Disclosure Application in accordance with RDC 38.65.
5. The Defendant’s costs of and incidental to the Disclosure Application be immediately assessed in the sum of AED 59,062.50 in accordance with RDC 38.28.
6. The Claimant pay the Third Respondent’s costs as set out in paragraph (3) above within 14 days of the date of this order in accordance with RDC 38.40.
7. The Claimant pay the Defendant’s costs as set out in paragraph (5) above within 14 days of the date of this Order in accordance with RDC 38.40.
