UPON the Claimant's application for summary assessment of its costs of the proceedings as against the First and Second Defendants
AND UPON hearing counsel for the Claimant
IT IS ORDERED THAT:
1. The Claimants costs of the proceedings up to and including 3 November 2009 are summarily assessed in the amount of US$13,028, the First and Second Defendants to pay 50% of that amount, being US$6,514.
2. The Claimant's costs of the proceedings from 4 November 2009 to 22 November 2009 are summarily assessed in the amount of US$28,115.
3. The Claimant's costs of the adjournment of the proceedings are summarily assessed in the amount of US$3,607.
4. The Claimants costs of the Assessment Hearing are summarily assessed at US$6,211.50.
5. The First and Second
Defendant to pay to the Claimant the amount of AED 5,145 (US$1,400) representing
Court fees paid by the Claimant as follows:
a. AED 735 for Order of
Registrar of 10 November 2009;
b. AED 3,675 for setting down of hearing of 18 November 2009;
c. AED 735 for Order of 18 November 2009.
6. The First and Second Defendants shall have leave to appeal the Registrar's decision to allow the Claimant's profit costs only insofar as determining the appropriate hourly rate.
