UPON considering the application of the Second Defendant for permission to appeal the costs order made by Justice Sir David Steel dated 12 April 2016 and the reasons annexed thereto
AND UPON reading the Second Defendant’s Grounds of Appeal and Skeleton Argument
AND UPON considering the documents on the Court File
AND IN ACCORDANCE with Part 44 of the Rules of the DIFC Courts
AND notwithstanding that the decision of Deputy Chief Justice Sir David Steel involved, inter alia, the exercise of a discretion, the Second Defendant’s proposed grounds of appeal are sufficiently arguable to merit the grant of appeal pursuant to RDC 44.8(1)
IT IS HEREBY ORDERED THAT the Second Defendant be granted permission to appeal the said costs order of Deputy Chief Justice Sir David Steel dated 12 April 2016 on the grounds put before the Court in support of the application herein.
