CASE MANAGEMENT ORDER OF JUSTICE RENE LE MIERE
UPON the matter being listed for a Case Management Conference pursuant to Part 26 of the Rules of the DIFC Courts (the “RDC”) on 18 November 2024 before Justice Rene Le Miere
AND UPON the agreement of the Claimant and the Defendant to the following directions
IT IS HEREBY ORDERED THAT:
1. A Case Memorandum, List of issues and Case Management Information Sheet shall be lodged with the Court no later than 4pm (GST) on 28 November 2024.
Production of Documents (RDC Part 28)
2. Each party shall make standard production of documents by no later than 4pm (GST) on 21 March 2025.
3. If parties may, if required, file and serve a Request to Produce by no later than 4pm (GST) on 4 April 2025.
4. Objections to Requests to Produce, if any, shall be filed by no later than 4pm (GST) on 18 April 2025.
5. Where there are no objections to a particular Request contained in a Request to Produce, documents responsive to that request shall be produced within 21 days from the date of the Request to Produce, and in any event, by no later than 4pm (GST) on 25 April 2025.
6. If a party is not satisfied with the objections to any Requests to Produce, it may apply to the Court for a Document Production Order by 4pm (GST) on 25 April 2025 using the Part 23 Form. The usual timelines under RDC 23, for progression of such an application, will apply. Nothing in this paragraph shall prevent the parties from making further applications for Document Production Orders after this date.
7. Once the Document Production Application is fully progressed, the matter will be put before the Court for determination.
8. The parties shall comply with the terms of any Disclosure Order and file a Document Production Statement within 7 days from the date of the Document Production Order.
Witness Statements (RDC Part 29)
9. Signed statements of witnesses of fact and hearsay notices, where required, shall be served no later than 4pm (GST) on 11 June 2025.
10. Supplementary statements of witnesses of fact shall be served within 3 weeks after that and, in any event, by no later than 4pm (GST) on 2 July 2025.
11. Unless otherwise ordered, Witness Statements shall stand as evidence in chief of the witness at trial.
Expert Reports (RDC Part 31)
12. The Claimant and the Defendant are each granted permission to rely on expert evidence from one appropriate handwriting expert regarding the forgery issues in the case falling within their expertise.
13. Expert reports, if any, shall be filed and served by no later than 4pm (GST) on 30 July 2025.
14. Any responsive to or supplemental expert report shall be filed and served by no later than 4pm (GST) on 20 August 2025.
15. The parties are at liberty to apply for directions concerning a meeting and discussion between experts.
Pre-Trial Review (RDC Part 26)
16. A pre-trial review shall be listed at 10am (GST) on 19 September 2025 being within the normal range of 4 to 8 weeks before trial.
Trial Bundles (RDC Part 35)
17. The parties shall liaise and seek to agree a trial bundle index no later than four weeks before trial.
18. Agreed trial bundles (prepared by the claimant) shall be filed and served no later than two weeks before trial.
Reading List and Trial Timetable (RDC Part 35)
19. An agreed reading list for trial, along with an estimate of the time required for reading and an estimated timetable for trial, shall be filed with the Court by the Claimant no later than four clear days before trial.
Skeleton Argument and Chronology (RDC Part 35)
20. Skeleton Arguments shall be filed and exchanged four clear days before the start of the trial.
21. The parties shall prepare an agreed chronology of significant events cross-referenced to significant documents, pleadings, and witness statements, which shall be filed with the Court by the Claimant no later than four clear days before trial. If there are areas of disagreement, the Chronology shall include an agreed Chronology and a Chronology of events which are disputed, with the parties’ respective positions outlined therein.
Trial (RDC Part 35)
22. The trial of this matter shall be listed at 11am GST) on Monday 20 October 2025 with an estimated duration of four days.
Costs
23. Costs of the Case Management Conference shall be costs in the case.
