UPON the Part 7 proceedings herein for recognition of an English Commercial Court Order commenced on 2 March 2021
AND UPON the Claimant’s Particulars of Claim filed on 28 February 2021 and the Defence of the Defendant filed on 18 April 2021
AND UPON the agreement of the parties on 3 May 2021 for an extension of time until 4pm on 24 May 2021 and their agreement on 24 May 2021 to a further extension of time until 4pm on 31 May 2021 for the filing of the Reply
AND UPON the Claimant and the Respondent having agreed not to take any steps in these DIFC Court proceedings pending the outcome of the related English proceedings entitled Aramco Trading Fujairah FZE v Gulf Petrochem FZC bearing the Commercial Court Claim No. CL– 2020-000696 (the “English Proceedings”)
AND UPON the Claimant having agreed with the Respondent that it will not seek recognition and enforcement of the Order dated 22 December 2020 in the English Proceedings before any Court of the UAE pending the outcome of the English proceedings
IT IS HEREBY ORDERED BY CONSENT THAT:
1. The present proceedings are stayed pending the outcome of the related English proceedings entitled Aramco Trading Fujairah FZE v Gulf Petrochem FZC bearing the Commercial Court Claim No. CL–2020-000696.
2. Liberty to apply.
3. Costs in the case.
