UPON reviewing the application of the Applicants dated 13 August 2018 pursuant to Articles 46 and 71 of the DIFC Insolvency Law 2009 for the removal of Neville Kahn as a joint liquidator of ES Bankers (Dubai) Limited (in liquidation) following his resignation, his release as a joint liquidator, and the appointment of David Soden in his place;
UPON reading the Applicants’ written evidence filed with the application notice;
AND UPON acceding to the Applicants’ request to determine the application on paper without an oral hearing;
IT IS HEREBY ORDERED THAT:
1. Neville Kahn’s resignation as liquidator is confirmed and he is hereby removed as a joint liquidator of ES Bankers (Dubai) Limited (in liquidation) (the “Company”).
2. Neville Kahn’s release as liquidator shall take effect within 28 days from the date of this order.
3. David Soden is hereby appointed as a liquidator of the Company and shall hold office jointly with Phil Bowers, on the same terms as Phil Bowers and Neville Kahn had held appointment as joint liquidators of the Company.
4. The costs of the Applicants’ application shall be paid as an expense in the liquidation of the Company.
