UPON the directions hearing held on 4 August 2020 before the Deputy Registrar Nour Hineidi (“Directions Hearing”) with the Claimant being represented by Mazen Boustany of Baker McKenzie Habib Al Mulla and the Second Defendant’s failure to appear

AND UPON reviewing the jurisdictional challenge application made by the Second Defendant on 8 July 2019 (the “Application”)

IT IS HEREBY ORDERED THAT:

1. The Second Defendant, Ali Mohamed Salem Abu Adas, has until till 4pm on Thursday, 13 August 2020 to let the Claimant and the DIFC Courts’ Registry know whether he intends on proceeding with the Application.

2. In the event the Second Defendant, pursuant to paragraph 1 of this order, signals his intention to proceed with his Application, then the Second Defendant will have until 4pm on Monday, 17 August 2020 to file further documents in support of that Application and the Claimant will have until 4pm on Monday, 24 August 2020 to file its response to the Application.

3. In the event the Second Defendant does not signal his intention, pursuant to paragraph 1 of this Order, to continue on with the Application, then the Application is deemed dispensed with and the case as against the Second Defendant must proceed on the basis that no jurisdictional challenge was filed by the Second Defendant.

4. The Second Defendant shall pay the Claimant’s costs of the Directions Hearing to be immediately assessed in the amount of USD 500.
